1. Overview

These Terms govern your use of the upload pages, credits, URLs, QR codes, NFC-ready links, and all related services (the "Platform") provided by ScanItHub. By purchasing or using credits, or by uploading or scanning content on the Platform, you agree to these Terms.

You must be at least 16 years of age to use the Platform (or 13 in jurisdictions where parental consent is provided in accordance with local law).

2. Credits

Credits are digital consumables purchased to access Platform features.

1 credit activates one upload page with a unique URL, QR code, and NFC-compatible link.
Credits are delivered instantly on successful payment.
Credits do not expire.
Credits do not represent ownership of any specific URL, QR code, or NFC tag.
We may update, modify, or replace the credit system, including pricing, at any time. Credits already issued retain their face value (1 credit = 1 upload page activation) regardless of pricing changes.

3. Upload Pages

Each activated upload page includes:

A unique URL
A printable QR code in PNG format at print resolution
An NFC-compatible link
Up to 100 MB of upload storage
PIN-protected editing
Scan-rate limiting to protect against abuse
Hosting for the lifetime of the Platform (see §4)

Upload pages may be archived, removed, or modified in accordance with these Terms. We may remove inactive, abandoned, or policy-violating content at our discretion, with at least 30 days' email notice to the address on your account where reasonably possible.

4. Hosting & Platform Lifetime

Hosting is included for the lifetime of the Platform, not the lifetime of any individual QR code, NFC tag, or URL.

"Lifetime of the Platform" means as long as the Platform continues to operate in its current or successor form. We may migrate, restructure, or discontinue parts of the Platform at any time.

If we discontinue any part of the Platform that affects your content, we will:

Notify you by email at least 90 days in advance where reasonably possible
Provide you with the ability to download your uploaded content before any removal
Honour any remaining unused credits with equivalent functionality in a successor product, or refund their pro-rata value at the original purchase price

5. Content Ownership & Responsibility

You retain all ownership of the content you upload.
You are responsible for ensuring your content complies with all applicable laws.
You grant ScanItHub a worldwide, non-exclusive, royalty-free licence to store, display, deliver, transcode, and back up your content solely as required for the Platform to function. This licence ends when you delete the content or when your account is closed, subject to reasonable backup-retention periods (up to 90 days for audit and disaster-recovery purposes).
We may remove or restrict content that violates these Terms or our policies.

6. Prohibited Content

The following are strictly prohibited:

Child Sexual Abuse Material (CSAM) or any content sexualising minors — automatically detected via industry-standard moderation, reported to authorities including the National Center for Missing & Exploited Children (NCMEC) where applicable, and resulting in immediate permanent termination with no refund
Non-consensual intimate imagery ("revenge porn")
Terrorism, incitement of violence, threats, or hate speech
Copyright-infringing material (DMCA takedowns honoured at copyright@scanithub.com)
Trademark-infringing material
Malware, scripts, executable files, or attempts to bypass safety checks
Phishing, fraud, or impersonation content
Personal data of others uploaded without consent
High-risk regulated content including but not limited to: medical advice, financial or investment advice, legal advice, gambling content, regulated political campaign content
Content intended for unauthorised mass distribution, commercial abuse, or any use that violates §7 (rate limits and fair use)

All uploads pass through automated content safety checks (file-type validation, malware scanning, and image moderation). We reserve the right to remove any content and suspend any account without refund where these Terms are violated.

7. Rate Limits & Fair Use

During the initial activation of an upload page, you may upload up to the 100 MB storage cap in a single session, without per-upload limits
After activation, content edits are limited to one edit batch per 24 hours per upload page
Public views of any upload page are subject to a soft daily limit of 500 scans per day and a burst limit of 100 scans per minute
Sustained traffic above 5,000 scans per day on a single upload page is throttled and may require an upgrade to a campaign-tier SKU
Per-IP burst across all upload pages is limited to 50 scans per minute per IP
Automated scanning, scraping, or unauthorised programmatic access is prohibited
Sustained abuse, fraudulent purchase attempts, or chargebacks may result in suspension of unused credits, removal of content, and a permanent block on future purchases — all without refund

8. PIN Security & Account Recovery

Editing an upload page requires a 4-digit PIN (6 digits for memorial-template and partner-issued pages).

You are responsible for keeping your PIN secure
After 5 failed PIN attempts on a single page within an hour, that page is locked from PIN-entry for 24 hours
After 3 failed attempts, we send a security notification to the email used at purchase
If you lose your PIN, you can request a one-time magic-link sign-in email. Magic links expire after 15 minutes and can be used to reset your PIN.
If you also lose access to your email, we cannot recover your PIN. You may need to activate a new upload page using a credit.

9. NFC Tags & Third-Party Hardware

You may write the URLs issued to you onto any NFC tag you own
We are not responsible for third-party NFC tags, encoding apps, printing services, or QR-scanning apps
Compatibility may vary depending on device, tag type, smartphone model, or operating system version

10. Payments & Refunds

Payments are processed by Paddle, acting as the Merchant of Record. Paddle handles tax collection, remittance, and chargeback management.

Credits are delivered instantly on successful payment

Refunds — EU and UK consumers: You have the right to withdraw from this purchase within 14 days of payment under the EU Consumer Rights Directive and the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. By using a credit to activate an upload page within this 14-day window, you waive your right of withdrawal for that specific credit. Unused credits remain refundable in full within 14 days.

Refunds — all other regions: Credits are non-refundable once issued, except where required by your local consumer protection law.

Taxes: Sales tax, VAT, GST and other applicable taxes are collected and remitted by Paddle based on your location.

11. Service Modifications

We may update, modify, or discontinue any part of the Platform at any time. If changes materially affect your existing content or unused credits, we will notify you by email at least 30 days in advance where reasonably possible.

12. Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy at www.scanithub.com/privacy-policy.

You have the right to: Access, Export, Correct, Delete, Object, and Lodge a complaint with your local data protection authority.

To exercise any of these rights, email legal@scanithub.com or use the data-export and delete-account tools in your dashboard.

13. Liability Limitation

The Platform is provided "as is" and "as available" without warranties of any kind. Our maximum aggregate liability is capped at the greater of: (a) the total amount you paid in the 12 months preceding the event, or (b) one hundred US dollars (USD $100).

14. Termination

We may suspend or terminate access if you violate these Terms, upload prohibited content, abuse rate limits, or initiate fraudulent payments.

15. Changes to These Terms

Material changes are notified 14 days in advance by email. The current version is always available at www.scanithub.com/terms-of-service.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of [TO BE CONFIRMED — likely Jersey or England & Wales], without regard to conflict-of-laws principles.

17. Severability

If any provision of these Terms is found to be unlawful, that provision shall be severed; the remainder remains enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ScanItHub regarding the Platform.
